Former mayor charged with two felonies

PENN YAN—Former Penn Yan Mayor Douglas Marchionda Jr., 42, was arrested by Yates County Sheriff’s Deputies May 28, and charged with grand larceny fourth degree and falsifying business records first degree, both E felonies.
A ticket was issued and Marchionda will appear in Penn Yan village court on a later date to answer the charges. If convicted, E felonies can carry sentences of up to four years.
Charges were made following investigation by New York State Department of Motor Vehicles (DMV).The issue was sales tax fraud in connection with purchase of a motor home in 2005. It is alleged that Marchionda falsified the amount paid for the vehicle in order to pay a lower sales tax on the purchase.
Yates County Sheriff Ron Spike said the issue involved sales tax fraud. Investigation was carried out by the Rochester DMV Field Investigation Office. Spike said, “DMV has their own investigators and always involve local agencies. They are the ones who file the charges, not us.”
Marchionda served in the village for 18 years, 10 years as trustee and the last eight years as mayor.
