Marchionda pleads not guilty in county court

PENN YAN—Former Penn Yan Mayor Douglas Marchionda Jr., of 344 Elm St. in Penn Yan, appeared before Judge Dennis Bender in Yates County Court Jan. 7 to answer charges of Fourth Degree Grand larceny and First Degree Falsifying Business records, both Class E felonies. A Yates County Grand Jury indicted Marchionda on the charges on Dec. 10, 2010.
Marchionda pled not guilty in court on Jan. 7 and the case was adjourned to March 10. Following the proceedings, Steuben County District Attorney John Tunney, whose office is prosecuting the case, said the adjournment will allow both sides to prepare motions.
Marchionda was arrested on May 28, 2010. The charges are related to purchase of a used motor home in 2005. At the time of purchase, the stated price of the vehicle was lower than was actually paid. Marchionda appeared several times in Penn Yan Village Court.  However no agreement could be reached at the time.
