Planning board approves Taco Bell site plan

PENN YAN—The Yates County planning board approved a site plan review Thursday, April 24, for a new Taco Bell restaurant. The restaurant would be located at 208-212 Lake St. and would include a 42 seat dining room and a drive-thru. Indus Real Estate II LLC is the developer for the restaurant, and is the same group that will begin construction on the Elm Street Microtel in the village in May.
Indus Engineer and Development Manager Kip Finley said the restaurant’s design would be the standard, modern prototype. He pointed to the newly-opened Taco Bell in Bath as an example of the new prototype. Finley said the restaurant will stay open from 7 a.m. to 2 a.m. the next morning, only closing for five hours a day.
The only separation between the proposed restaurant’s parking lot and the sidewalk will be a curb and a little bit of green space, but Finley says the lack of a larger buffer is not a concern. He said the restaurant is not required to put in a larger barrier because it’s not in a historical district.
In other business:
• Applicant Andrew Castelluzzo was granted an area variance and site plan review for his property at 1396 Anthony Road in Torrey. The plan is for Castelluzzo to build a 20 by 32 foot addition onto an existing home. The addition is for a bedroom, office and three-quarters bathroom.
• The Penn Yan Public Library at 214 Main St. had a site plan review denied by the board to remove and replace the rear parking lot, building entry and construct an outdoor learning area. Planning Chairman Ron Rubin said the site plan presented is incomplete and should be resubmitted to the board at a later date. Library County Historian Fran Dumas said the application is for a phased project, and the outdoor learning center is not appropriate for a national register historic preservation district simply because of the very nature of a learning center. She said the village’s ordinance will not allow that project to go in front of the building. Library Director Angela Gonzalez said they want to begin construction by mid-summer and be completed by mid-fall. She said there would be four additional parking spaces in the new lot and she will be communicating with local churches to deal with parking during construction.
• The board approved multiple area variances to Paul and Marian Walrath to build a single-family dwelling and accessory buildings. Paul Walrath said they want to make this a year-round residence and demolish the existing dwelling and accessory buildings at 520 East Lake Road in Milo. He said they would like to build a garage on that lot, which would exceed the town height limit, for which he also received an additional variance.
• The board granted Java-Gourmet a special use permit and site plan review at 2792 Route 54A in Jerusalem. The application is to separate the residential and commercial properties.
• Hermann J. Weimer Vineyards was granted a special use permit at 3962 Route 14 in Starkey. The permit is for an 850 square-foot wing to be used as a tasting room, kitchen and bathrooms, and to construct a 1,455 square foot roof over their press pad.
• Scott Fladd, representing Demetrios Pappan, was granted an area variance to modify an existing sign at 220 Lake St. in Penn Yan.
