Yates Court arraigns two for tampering

YATES COUNTY--Charles R. Taylor, 25, and Richard S. Taylor, 22, were arraigned Friday, Oct. 7, and were charged with tampering with physical evidence, a class E felony, which carries a maximum sentence of up to 1.3 to four years in state prison. The two were arraigned before acting Yates County Court Judge, Hon. Dennis F. Bender, who remanded both men to Yates County Jail in lieu of bail set in the amount of $1,000 cash or $2,000 fully secured bond. The arraignments came acting on sealed indictments handed down by a Yates County Grand Jury after presentation by District Attorney Valerie Gardner Sept. 1.
The charges stem from an incident Nov. 8, 2015, involving the fatal heroin overdose of a 17-year-old Dundee area female and involve the allegations that the pair took actions to conceal physical evidence consisting of syringes containing purported heroin residue.
According to District Attorney Valerie Gardner, the purpose of the "Good Samaritan" provision is to encourage victims and witnesses of overdose events to focus their efforts on immediately seeking medical help by providing immunity from certain controlled substance offenses such as possession.
"The law does not provide immunity or excuse to those who divert their attention from the medical crisis in order to hide evidence," said Gardner.
Gardner credits the efforts of New York State Police investigators and troopers for the investigation, interviews and evidence collection that led to the arrests.
